Emmanuel Apostolic Church – Terms of Use

Emmanuel Apostolic Church (“Emmanuel,” “EAC,” “us,” or “we”) owns and operates this website and any related online pages, livestream services, embedded media, donation links/portals, and online forms (collectively, “our Site” or the “Services”). These Terms of Use (“Terms”) govern your access to our Site and your use of the Services.

ACCEPTANCE OF THESE TERMS

Please read these Terms carefully before accessing or using the Site, as these Terms affect your legal rights. By accessing or using the Site, you are entering into a binding agreement with Emmanuel Apostolic Church in accordance with these Terms. If you do not agree to these Terms, you should not use the Site.

DISPUTE RESOLUTION NOTICE (CHURCH-FIRST RESOLUTION)

If a dispute arises relating to your use of the Services, you agree to first contact us and attempt in good faith to resolve the matter informally. If we are unable to resolve the dispute within a reasonable period, either party may pursue resolution through mediation or other appropriate dispute-resolution mechanisms in Jamaica, and where necessary, the courts of competent jurisdiction in Jamaica.

Nothing in this section limits either party’s right to seek urgent relief where required by law.

COOKIES, PIXELS, AND OTHER TRACKING TECHNOLOGIES

We may use cookies and similar technologies (“Tracking Technologies”) on the Services to help the Site function properly, improve your experience, understand how visitors use our Site, and support basic analytics.

Some third-party services we use (such as video players, livestream platforms, social media embeds, or donation processors) may also use their own tracking technologies. By using the Services, you consent to our use of Tracking Technologies as described above and to the extent applicable through third-party services. You can manage cookies through your browser settings; disabling cookies may impact certain features.

ONLINE CHAT NOTICE

If our Site includes an online chat feature, it may be supported by a third-party service provider and may use automation or artificial intelligence to help route and respond to messages more efficiently.

By using the chat feature, you consent to the collection and processing of the information you submit (including chat transcripts and contact details) for purposes of responding to your request and providing ministry support. If you prefer not to use chat, you may contact us directly by phone or email.

CHANGES TO THESE TERMS

We reserve the right to change these Terms at any time. All changes will be effective immediately upon posting to the Site. Each time you access or use the Site after changes are posted, you consent to those changes. If you disagree with any future changes to these Terms, you may discontinue use of the Site.

TERMS OF USE

PRIVACY

We may collect certain personal information from you when you use the Site (for example, when you submit a form, register for an event, request prayer, or contact us). “Personal Information” includes information that can reasonably be linked to you (such as name, email address, phone number, or other identifiers you submit).

We use this information for ministry and administrative purposes, including responding to requests, coordinating events, communicating announcements, and supporting church operations. If you share sensitive information (for example, in a prayer request), we will treat it with care and only share it internally where necessary for ministry support.

Third-party services (such as livestream and donation platforms) may collect information under their own policies. Please review their policies when using those services.

OWNERSHIP OF THE SITE AND CONTENT: INTELLECTUAL PROPERTY

Ownership of Site and Content

The Site and all content made available through it (“Content”) are owned by Emmanuel Apostolic Church or used with permission. “Content” includes sermons, teachings, writings, text, designs, audio and video clips, graphics, photographs, illustrations, logos, icons, software elements, and the overall look and feel of the Site.

Intellectual Property Rights

The Site and Content are protected by intellectual property laws. You may not use the Content except as expressly permitted under these Terms. Any unauthorized use is prohibited.

Trademarks

The name “Emmanuel Apostolic Church,” related logos, and branding elements are trademarks or identifiers of the Church and may not be used in a way that suggests endorsement or affiliation without written permission.

PURPOSE OF THE SITE

We provide the Site and Content as a convenience to members, visitors, volunteers, and the wider community. While we aim to keep the information accurate and up to date, we do not guarantee completeness, accuracy, or timeliness. Content may be updated, corrected, or removed at any time without notice.

These Terms permit you to use the Site for your personal, non-commercial use only unless we provide written permission otherwise.

We reserve the right, in our discretion, to:

(a) correct errors or omissions;

(b) modify or discontinue any part of the Site;

(c) add, modify, or delete Content;

(d) suspend access temporarily or permanently; and/or

(e) take steps we consider necessary to protect the integrity of the Site and our community.

ACCEPTABLE USE

If you use the Site, you must comply with the following restrictions:

No Scraping

You may not access the Site using robots, spiders, crawlers, scripts, scraping tools, or any automated means to extract Content.

No Copying or Republication

You may not copy, reproduce, republish, distribute, sell, or exploit the Content except for personal, non-commercial use, unless we give written permission.

No Unauthorized Sharing of Content

You may not modify, adapt, translate, create derivative works from, publicly perform, or publicly display Content without permission.

No Linking or Framing Without Permission

You may not frame the Site or present it in a way that suggests it is part of another site without written authorization. If we permit linking, you must not link in a way that damages our reputation or creates confusion about affiliation.

No Inappropriate Content

You agree not to submit content that is vulgar, abusive, hateful, sexually explicit, discriminatory, harassing, or inappropriate for minors.

Limits on User-Submitted Materials

You agree not to submit materials that are defamatory, threatening, misleading, deceptive, fraudulent, or that violate the rights of others (including privacy and intellectual property rights).

Protection of Personal Information

You must not disclose another person’s personal information or image without their consent (and in the case of minors, without the consent of a parent/guardian).

No Harmful Behavior / No Hacking

 

You may not upload malware, attempt unauthorized access, interfere with the Site’s operation, or disrupt connected systems or networks.

No Commercialization / Spam

You may not use the Site to advertise or promote goods/services without permission, or to send spam, chain letters, or unwanted solicitations.

If you violate this section, we may restrict or terminate your access and take any action available under law.

LIVESTREAMS, PHOTOGRAPHY, AND MEDIA NOTICE

Services and events at Emmanuel Apostolic Church may be recorded, photographed, or livestreamed. By attending our services/events or participating in recorded spaces, you acknowledge your image and/or voice may be captured and used for ministry purposes, including online broadcast and promotional materials.

DONATIONS / GIVING

If you choose to provide a donation through the Emmanuel Apostolic Church website or any associated online giving links or platforms (collectively, the “Giving Services”), you may be required to provide certain personal, contact, and financial information, including but not limited to your name, email address, phone number, and payment details, in order to process your donation.

We may collect and record donation designations, where provided by you, to ensure that your contribution is applied in accordance with your stated intent and for Church administration, accounting, and record-keeping purposes. We may also use your contact information to provide donation confirmations, acknowledgements, annual giving statements (where applicable), and ministry-related communications.

Payment Processing

Online donations are processed through Fygaro, a third-party payment service provider. Emmanuel Apostolic Church does not store full credit card or banking information on its own servers. The collection, handling, processing, and security of your payment information are governed by Fygaro’s systems, terms, and privacy practices.

By using the Giving Services, you acknowledge and agree that your payment information will be processed by Fygaro solely for the purpose of completing your donation.

Finality of Donations

All donations made to Emmanuel Apostolic Church are voluntary and are generally considered final and non-refundable, except where required by applicable Jamaican law or where the Church, in its sole discretion, determines that exceptional circumstances warrant review.

As a faith-based, non-profit ministry, all donations are used to support the spiritual mission, ministry operations, and community outreach of Emmanuel Apostolic Church.

Giving Errors and Duplicate Transactions

If you believe that a donation was submitted in error, duplicated, or processed for an incorrect amount, you must notify Emmanuel Apostolic Church promptly by contacting us at eachqt_1@yahoo.com or 1 (876) 948-3221.

Upon review, and at the Church’s sole discretion:

• we may work with Fygaro to investigate the transaction, and
• where appropriate and feasible, take corrective action, which may include issuing a refund or adjustment.

Requests made significantly after the transaction date may not be eligible for review due to processor limitations or accounting finalization.

Communication Related to Giving

By using the Giving Services, you acknowledge and agree that Emmanuel Apostolic Church may contact you from time to time by email, phone, or other reasonable means to:

• confirm or acknowledge donations
• provide giving statements or records
• share information about Church programs, events, and ministry initiatives

You may opt out of non-essential communications at any time by contacting the Church.

THIRD-PARTY WEBSITES AND SERVICES

The Site may contain links to third-party websites or services (e.g., YouTube, Facebook, Instagram, Zoom, payment processors). Your use of third-party services is at your own risk. We are not responsible for third-party content, policies, availability, or security.

DISCLAIMER OF WARRANTIES

To the maximum extent permitted by Jamaican law, the Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that defects will be corrected.

You use the Services at your own risk and are responsible for your device, data, and connectivity.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, Emmanuel Apostolic Church will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the Services.

INDEMNIFICATION

Except as prohibited by law, you agree to indemnify and hold harmless Emmanuel Apostolic Church and its leadership, workers, and agents from claims and expenses arising out of:

(a) your misuse of the Services;

(b) your violation of these Terms; or

(c) your violation of another person’s rights.

TERMINATION

We reserve the right to deny, suspend, or terminate access to the Services at any time, without notice, if we believe it is necessary to protect the Site, the Church, or the community, or where misuse is suspected.

SEVERABILITY

If any part of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

GOVERNING LAW

These Terms are governed by the laws of Jamaica, and any disputes will be handled in Jamaica subject to the dispute-resolution section above.
